The stamp paper value for a rent agreement depends on your state, the rent, the deposit and the length of the lease; ₹100 is not a national rate. For an 11-month home rental, Karnataka caps the duty at ₹500, Telangana charges 0.4% of the total rent and Delhi charges 2%. In most states, a lease longer than one year must also be registered, which adds a registration fee.

Key facts

State Stamp duty on a residential rent agreement Registration fee (if registered)
Delhi Under 1 year: 2% of the total rent for the term ₹1,000 plus ₹100 pasting fee
Maharashtra (leave and licence, up to 60 months) 0.25% of total rent + non-refundable deposit + 10% a year notional interest on the refundable deposit ₹1,000 urban, ₹500 rural; registration compulsory for all terms
Karnataka Up to 1 year: 0.5% of average annual rent + deposit + premium, maximum ₹500 Check the Kaveri 2.0 calculator
Uttar Pradesh Flat or building up to 5 years: 2% of total rent + premium or money advanced, minimum ₹100, maximum ₹10,000 (concessions below) Check igrsup.gov.in
Tamil Nadu Lease below 30 years: 1% of total rent, premium, fine and similar amounts 1%, maximum ₹20,000
Telangana Under 1 year: 0.4% of total rent; 1–5 years: 0.5% of average annual rent 0.2% of total rent (under 1 year) or of average annual rent

Other states use different rates. Check your state’s schedule, or our stamp duty by state page, before you buy stamp paper.

How rent agreement stamp duty is calculated

Every state charges duty under its “lease” article: Article 35 in the central Indian Stamp Act schedule and in Delhi and UP, Article 30 in Karnataka, and Article 36A for leave and licence in Maharashtra. Three things decide the amount:

ItemDetails
The term.Short leases are charged on the total rent for the term. Longer leases are usually charged on the average annual rent, at a higher rate as the term grows.
The rent. The monthly rent multiplied by the months in the term, or averaged per year.
Deposit and premium. Most states add a premium, fine or “money advanced”. Karnataka’s schedule says money advanced includes a security deposit, whether refundable or adjusted against rent. Maharashtra counts the non-refundable deposit in full and adds notional interest on the refundable part.

So “₹100 stamp paper for rent agreement” is only right where the state’s formula happens to give ₹100 or less. Our Rs 100 stamp paper guide explains when that denomination is enough.

State rules in more detail

Delhi

For a lease under one year, the duty is the bond rate, 2% in Delhi, on the whole rent payable. An 11-month agreement at ₹20,000 a month has total rent of ₹2,20,000, so the duty is ₹4,400. The Delhi Revenue Department says the tenant (lessee) pays the duty on a lease or rent deed. Registered lease deeds pay a ₹1,000 registration fee plus a ₹100 pasting fee.

Maharashtra

Article 36A of the Maharashtra Stamp Act covers leave and licence agreements of up to 60 months. The duty is 0.25% of the total rent plus any non-refundable deposit, plus notional interest at 10% a year on the refundable deposit. Agreements over 60 months are charged as leases under Article 36. Section 55 of the Maharashtra Rent Control Act, 1999 requires every leave and licence or tenancy agreement to be registered, whatever its length. The Leave and License 2.0 portal calculates the exact duty and fee.

Karnataka

Article 30(1)(i) charges 0.5% on the average annual rent, premium, fine and money advanced for a residential lease of up to one year, with a maximum of ₹500. Once the rent and deposit together pass ₹1 lakh, the cap applies, so most city rentals pay ₹500. Rates rise for longer terms, and the lessee pays unless the parties agree otherwise.

Uttar Pradesh

UP’s Schedule I-B charges the letting of a building or flat for up to five years at 2% of the total rent for the term plus any premium or money advanced. The minimum is ₹100, the maximum ₹10,000, and the amount is rounded up to the next ₹10.

From 19 November 2025 UP notified a six-month remission that capped duty for leases of up to 10 years. The cap was ₹500 for a one-year lease with annual rent up to ₹2 lakh. On 15 September 2026 the state cabinet decided to make a revised concession permanent. According to Dainik Jagran, the combined stamp duty and registration fee under the approved structure is:

Average annual rent Up to 1 year 1–5 years 5–10 years
Up to ₹2 lakh ₹2,000 ₹4,000 ₹8,000
₹2 lakh to ₹6 lakh ₹6,000 ₹12,000 ₹16,000
₹6 lakh to ₹10 lakh ₹9,000 ₹20,000 ₹26,000

For the first slab, that is ₹1,000 stamp duty and ₹1,000 registration fee. We could not find the notification yet, so check igrsup.gov.in or the sub-registrar before relying on these figures.

Tamil Nadu

The state’s rate list charges 1% on the total rent, premium, fine and similar amounts for a lease below 30 years, with a registration fee of 1% capped at ₹20,000. An 11-month lease at ₹20,000 a month works out to ₹2,200 in duty on the rent alone.

Telangana

The Registration and Stamps Department’s ready reckoner charges 0.4% of total rent for a lease under one year, with a 0.2% registration fee. For residential leases of one to five years, the duty is 0.5% of the average annual rent. A premium or money advanced paid in addition to rent is charged 2% on that amount. At ₹20,000 a month for 11 months, duty on the rent is ₹880.

Buying an e-stamp for a rent agreement: what to enter

  1. Open the SHCIL e-stamping site or visit an authorised collection centre, and select your state.
  2. Enter the first party (usually the landlord) and the second party (the tenant) exactly as in the agreement.
  3. Select the article for lease or leave and licence, for example Article 35 in Delhi or UP, or Article 30 in Karnataka.
  4. Enter the property address, the consideration (total rent, plus deposit where your state counts it) and the duty amount.
  5. Choose who pays the duty; in Delhi and Karnataka this is normally the tenant.
  6. Pay and print the certificate, then print or attach the agreement and sign it with two witnesses.

Our e-stamp paper guide covers verifying the certificate. For the agreement itself, clauses and registration steps, see our rental agreement guide.

Registration fee on top of stamp duty

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases from year to year, for more than one year, or reserving a yearly rent. That is why most agreements are written for 11 months. Maharashtra is the exception here: registration is compulsory at any length. Registration fees are listed in the table above for the states we checked.

Penalty if the agreement is under-stamped

Under Section 35 of the Indian Stamp Act, a document that is not duly stamped cannot be admitted in evidence or acted upon. It can be admitted on payment of the missing duty plus a penalty of ₹5 or ten times the shortfall, whichever is higher. Under Section 40, the Collector can demand the duty with a penalty of up to ten times the shortfall. States set their own penalty rules, so an under-stamped agreement can cost far more than the duty saved. For a high-value or commercial lease, a lawyer can check the duty before you sign.

Frequently asked questions

What is the stamp paper value for an 11-month rent agreement?

It depends on the state: ₹500 at most in Karnataka for a home, 2% of total rent in Delhi and 0.4% of total rent in Telangana. Maharashtra and Tamil Nadu use their own formulas shown above.

Can I make a rent agreement on ₹100 stamp paper?

Only if your state’s formula gives ₹100 or less. Otherwise the agreement is under-stamped and can attract a penalty.

Is the security deposit included in stamp duty?

In Karnataka, yes: money advanced includes a refundable deposit. Maharashtra adds notional interest on the refundable deposit. Other states differ, so check the article for yours.

Who pays stamp duty on a rent agreement?

In Delhi and Karnataka the tenant pays by default. In Maharashtra, the portal lets you choose the licensee, the licensor or both.

Can I buy an e-stamp for a rental agreement online?

Yes, in states where SHCIL offers online self-print, such as Delhi, Karnataka and UP. Elsewhere, use a collection centre or the state’s own system.

Is a notarised rent agreement enough?

Notarisation only attests signatures. It does not replace stamp duty, or registration where the law requires it.
