A recovery agent cannot call you before 8:00 a.m. or after 7:00 p.m. That limit is in RBI’s circular of 12 August 2022 on the responsibilities of regulated entities employing recovery agents. The same circular bans persistent calling, threats, anonymous calls and public humiliation.
It applies to the lender, not only to the agent. RBI puts the duty on the regulated entity, so the bank or NBFC is answerable for what the agency it hired does. That is what makes the complaint route work.

What should you do while it is happening?
Write everything down. Date, time, the number that called, and what was said. Screenshot the messages. A call at 9:40 p.m. is a documented breach of a specific rule, and that is far stronger than a general complaint about rudeness.
Do not stop answering entirely. Ask for the agent’s name, the agency’s name and the lender they act for. RBI bans anonymous calls, so a refusal to identify is itself a breach worth recording.
Never pay cash to an agent at your door without a receipt on the lender’s letterhead. People pay twice this way. Pay into the loan account through the lender’s own channel, and keep the transaction reference.
Where do you complain?
Start with the lender. Write to its grievance redressal officer, name the circular, and attach your log. The bank or NBFC is the regulated entity, so the complaint belongs to it before it belongs to anyone else.
If the lender does not resolve it, escalate to the RBI Ombudsman through the RBI’s complaint management system at cms.rbi.org.in. The scheme requires you to approach the lender first, so keep the dated copy of that letter.
Where there is a threat of violence, criminal intimidation or an agent refusing to leave your home, that is a police matter and not only a regulatory one. File an FIR. The two routes run in parallel and neither replaces the other.
What harassment does not change
Here is the uncomfortable part. None of this cancels the debt. An agent who breaks the rules exposes the lender to regulatory action. The loan still stands, the interest still runs, and the default still shows on your credit record.
So run two tracks at once. Deal with the harassment through the complaint route, and deal with the loan through the lender’s restructuring or settlement desk. Understand the difference between the two outcomes before you agree to anything, because a settlement marks your record differently from a closure. If several loans are behind, look at whether a consolidation loan makes the payments manageable, and read your full set of borrower rights first. Once an account is settled or closed, check that the bureau record matches, and use the dispute process if it does not.
A warning about impersonation
Some of the worst calls are not from a lender at all. Callers claiming to be recovery agents, police or court officials are a known fraud pattern, and they use the same pressure the real ones do.
