Affordable housing in Haryana follows the Affordable Housing Policy 2013. Licensed private builders must sell flats of 28 to 60 sq m carpet area at a state-capped price, now ₹5,575 per sq ft in Gurugram after the 8 April 2026 amendment. Flats go by online draw on the TCP Department’s e-Draw portal. You pay 5% to apply and 20% on allotment.

How the policy works

The state gives builders extra density, floor area and commercial space on 4 to 30 acre plots. In return, every flat must be sold at the capped rate, and the project cannot be converted into a normal group housing colony. The builder also cannot set aside separate EWS flats.

Each project must be completed within 4 years of the “date of commencement”, which is the later of building plan approval and environmental clearance. A 2021 amendment allows the licence to be renewed after 4 years on payment of a fee, so delays do happen. Projects are registered with the Haryana Real Estate Regulatory Authority, and our HRERA Haryana guide shows how to check a project’s registration and case status.

Rate cap and flat sizes

The cap applies to carpet area, meaning the usable floor area inside the walls, including the kitchen, toilets and built-in cupboards. Walls and cantilevered balconies are left out.

Area 2013 Nov 2021 Jul 2023 Apr 2026
Gurugram ₹4,000 ₹4,200 ₹5,000 ₹5,575
Faridabad ₹4,000 ₹4,200 ₹5,000 ₹5,450
Other high and medium potential towns ₹3,600 ₹3,800 ₹4,500 ₹5,050
Low potential towns ₹3,000 ₹3,200 ₹3,800 ₹4,250

Rates are per sq ft of carpet area. Before 2026, Gurugram, Faridabad, Panchkula and Pinjore-Kalka shared one rate. The 2026 table puts Sohna in the Faridabad band and no longer names Panchkula or Pinjore-Kalka, so check the rate printed in the project advertisement.

The 2026 rates apply to every licence that has not yet made allotments. Where applications were already invited, the draw goes ahead on those applications, and successful applicants pay the difference. Anyone who does not want to continue at the new rate gets the application money back in full.

An example for Gurugram: a 600 sq ft carpet flat costs ₹33,45,000. With 100 sq ft of balcony at ₹1,300, the total is ₹34,75,000 before parking, taxes and other charges. Use the home affordability calculator to see whether the loan fits your income.

Eligibility and the draw

Anyone can apply. First preference goes to applicants whose household (self, spouse and dependent children) owns no flat or plot in a HUDA sector or licensed colony anywhere in urban Haryana, Chandigarh or Delhi. You may apply only once in a project, and you can keep only one flat under the policy even if you win in more than one draw. The builder may allot up to 5% of flats to its employees, associates or relatives at the same rates, with their names disclosed.

  1. Watch for the project advertisement. The builder must advertise through the circle’s Senior Town Planner in one English and two Hindi newspapers.
  2. Register on the e-Draw portal (edraw.tcpharyana.gov.in) and find the project by district, town or builder.
  3. Fill in the application and pay 5% of the flat cost online.
  4. Wait for scrutiny by the builder and the District Town Planner, which should finish within three months of the closing date.
  5. Check the result on the portal after the draw. A successful applicant with minor defects in the form gets 15 days to fix them.
  6. Pay 20% of the flat cost on allotment and sign the builder-buyer agreement.

Ineligible applicants get the 5% back within a month of scrutiny, without interest. Unsuccessful applicants are refunded within 15 days of the draw. If the flats do not sell after three advertisements, the builder can sell the rest on a first-come basis at the same capped rates.

Payment schedule and cancellation

Stage Share On a ₹34,75,000 flat
Application 5% ₹1,73,750
Allotment 20% ₹6,95,000
Construction-linked balance 75% ₹26,06,250

The original policy spread the 75% over six half-yearly instalments across three years. Since November 2021, the balance follows the construction stages written into the builder-buyer agreement. Check your EMI on a home loan for that amount with the EMI calculator.

If you miss an instalment, the builder sends a reminder giving 15 days. If you still do not pay, your name is published in a Hindi newspaper with another 15 days to pay, after which the allotment can be cancelled.

Surrender, refund and waitlist

If you surrender a flat, or the allotment is cancelled for non-payment, the builder can keep ₹25,000. On a surrender, the 2019 amendment lets it keep a further amount, but no more than:

When you surrender Extra deduction (maximum) On a ₹34,75,000 flat
Before the project commences Nil ₹0
Up to 1 year after commencement 1% of flat cost ₹34,750
Up to 2 years after commencement 3% of flat cost ₹1,04,250
After 2 years 5% of flat cost ₹1,73,750

Surrendered and cancelled flats go to the waiting list, which can hold up to 25% of the flats in the draw and is kept for 2 years. A waitlisted applicant who withdraws must be refunded within 30 days with no penalty. After 2 years, the booking amount is returned without interest. A waitlisted buyer who gets a flat later pays what other allottees have paid by that stage.

Resale lock-in and possession

The 2013 policy barred transfer or sale of a flat for one year after possession, with a penalty of 200% of the selling price. A September 2018 order from the Department treats that clause as deleted from 22 July 2015. Read the transfer terms in your allotment letter and agreement before you sell.

After the occupation certificate, the builder must maintain the colony for five years. A January 2024 clarification lists what the builder pays for in that period: roads, parks, lifts, common-area cleaning and lighting, the sewage plant and staff salaries. It also lists what you pay: your own electricity and water, property tax, diesel for power backup and door-to-door garbage collection. After five years, the apartment owners’ association takes over. If possession is delayed or charges look wrong, you can complain to HRERA. For complex disputes, a property lawyer can check your agreement.
